Terms of Service
These terms govern use of NurseTide Legal (the "Platform"), a marketplace connecting law firms, insurers and other legal clients ("Clients") with registered nurses offering legal nurse consulting ("Consultants").
1. The Platform's role
The Platform provides tools to post case briefs, exchange proposals, share records securely, collaborate on work product and pay for services. The Platform is not a law firm, does not provide legal or medical advice, and is not a party to the engagement between a Client and a Consultant. Consultants are independent contractors of the Client, not employees or agents of the Platform.
2. Accounts and verification
You must provide accurate information and keep your credentials secure. Consultants must hold an active, unencumbered nursing license and keep their license information current. We verify licenses and firms but do not guarantee any user's qualifications, conduct or work.
3. Case briefs
Briefs are visible to every verified Consultant. Clients must not include patient names, dates of birth, record numbers, contact details or other identifying information in a brief. Identifying information belongs only in the secure case workspace, after a Consultant is engaged.
4. Conflicts of interest
Clients list the parties involved in each case. Consultants must disclose relationships with any party and may not propose on cases where they have a conflict. Each proposal includes the Consultant's attestation that no conflict exists.
5. Payments
Clients pay the accepted proposal amount plus the Platform's service fee when engaging a Consultant. For hourly engagements this is a deposit, reconciled against logged time when the case closes. The Platform holds funds until the Client closes the case or accepts the Consultant's report, then releases them to the Consultant through our payment processor, net of any refund or dispute resolution.
6. Disputes
Either party may open a dispute about an engagement. Payouts are held while we review. Our resolution of the payment (release, refund or split) is final as to funds held by the Platform and does not limit either party's other legal rights.
7. Confidential and privileged material
Use of the case workspace is subject to the Engagement & Confidentiality Terms. Platform staff do not access case workspaces except as required by law or with the Client's written authorization.
8. Acceptable use, suspension and termination
We may suspend accounts that violate these terms, misrepresent credentials, or misuse confidential information. You may delete your account at any time from Settings, subject to completing open engagements.
9. Disclaimers and limitation of liability
The Platform is provided "as is". To the extent permitted by law, the Platform's liability is limited to the fees it received for the engagement giving rise to the claim.
10. Changes
We will notify users of material changes and record acceptance of new versions.
