Engagement & Confidentiality Terms
These terms apply between a Client and a Consultant for each engagement made through NurseTide Legal, and are accepted by the Consultant when proposing and by the Client when hiring.
1. Engagement
The Consultant is retained by the Client (or the Client's counsel) to assist with the case described in the brief. Work is performed at the direction of counsel, in anticipation of litigation, and is intended to be protected as attorney work product to the extent the law allows.
2. Confidentiality
The Consultant will keep confidential all case information, records and communications; use them only for the engagement; not disclose them to anyone except the Client; and not download, copy or retain records outside the workspace except as needed for the work, deleting any copies at the end of the engagement.
3. Protected health information
The Consultant will safeguard protected health information in accordance with HIPAA and applicable state law, and will report any suspected unauthorized access to the Client and the Platform without delay.
4. Conflicts of interest
The Consultant confirms there is no conflict of interest with the parties listed for the case and will disclose immediately any conflict that arises during the engagement.
5. Independence and opinions
The Consultant provides independent nursing analysis. Testimony, if any, is subject to a separate written agreement. The Client decides how work product is used.
6. Fees
Fees are as stated in the accepted proposal and paid through the Platform. Hourly work is billed against the deposit using time logged in the workspace.
7. Ownership
Work product created for the engagement belongs to the Client once paid for.
