New York medical malpractice: what to know before retaining a nurse
What is the statute of limitations for medical malpractice in New York?
Two and a half years from the act or omission, or from the end of continuous treatment for the same condition (CPLR 214-a). For a missed cancer diagnosis, Lavern's Law starts the clock at discovery, with an outer limit of seven years. A foreign object: one year from discovery.
What must be done before or when filing a medical malpractice case in New York?
No presuit notice against private defendants. With the complaint, counsel files a certificate that they consulted a licensed physician (or dentist or podiatrist) and believe there is a reasonable basis for the action (CPLR 3012-a). Claims against public hospitals need a notice of claim within 90 days (General Municipal Law § 50-e).
Who can give the expert opinion in New York?
In medical malpractice cases, a party may withhold the names of its experts when disclosing their opinions and qualifications (CPLR 3101(d)(1)(ii)).
Does New York cap medical malpractice damages?
No cap on compensatory damages. Future damages above $250,000 may be paid over time under the structured judgment rules for medical malpractice (CPLR Article 50-A).
Are nursing home cases different in New York?
Nursing home residents have a statutory right of action for deprivation of their rights (Public Health Law § 2801-d), with attorney fees available, alongside negligence claims. Courts have generally applied a three-year limitation to it.
