Failure to rescue and missed deterioration review

Failure to rescue describes a patient who deteriorates, often after surgery, without the warning signs being recognized and acted on in time. These cases turn on the hours before the event: what the vital signs and assessments showed, who was told, and how quickly they responded.

What the nurse reviewer examines

  • Vital sign trends and early warning scores against the frequency ordered and unit policy
  • Nursing assessments and reassessments after abnormal findings
  • Each escalation: who was called, when, what was said and what was ordered
  • Chain of command and rapid response activation criteria
  • Opioid and sedation monitoring, including capnography and pulse oximetry
  • Handoffs between shifts and transfers between units
  • Staffing and assignment on the shifts in question

Records to request

A starting checklist; the reviewer will flag what's missing once they have the chart.

  1. Vital sign flowsheets and monitor or telemetry data, with timestamps
  2. Nursing notes, including late entries and their audit trail
  3. Physician orders and call or page logs
  4. Rapid response and code records
  5. MAR, especially opioids and sedatives
  6. Facility policies on vital signs, escalation and rapid response
  7. Staffing records and assignment sheets

Questions attorneys ask

Why is a chronology important in failure-to-rescue cases?

The case usually turns on minutes and hours. A chronology that lines up vital signs, assessments, calls and orders on one timeline shows when the deterioration was recognizable and how long the response took.

Can the EHR audit trail matter?

Often. It shows when entries were actually made, which matters when notes were charted late or edited after the event.
